1. Acceptance of Terms
By creating an account or using the KampMal application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Effek Studios ("we", "us", "our").
2. Eligibility
You must be at least 18 years old or have the consent of a parent or legal guardian to use the Service. By using the Service, you represent that you meet this requirement.
3. Account Registration
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans
4.1 Free Plan ("Weekend Warrior")
The free plan includes ad-supported access to core features, limited to 1 vehicle and 1 trailer, and up to 10 AI trip plans per day.
4.2 Premium Plan ("Nomad")
The premium subscription provides ad-free access, unlimited vehicles, unlimited AI trip planning, marketplace access, one-click campsite bookings, offline maps, and license renewal reminders. Subscription fees are billed through PayFast and are non-refundable except as required by the Consumer Protection Act (CPA).
4.3 Cancellation
You may cancel your subscription at any time. Access to premium features will continue until the end of the current billing period.
5. Marketplace
5.1 General
The KampMal Marketplace allows users to buy and sell camping and overlanding gear. We act as an intermediary and are not a party to transactions between buyers and sellers.
5.2 Escrow
All marketplace payments are processed through PayFast escrow. Funds are held until the buyer confirms receipt of the item or 7 days after delivery confirmation, whichever comes first.
5.3 Seller Obligations
- Listings must accurately describe the item, condition, and price.
- Sellers must ship items within 3 business days of payment confirmation.
- Prohibited items: firearms, ammunition, illegal substances, counterfeit goods, stolen property.
5.4 Buyer Obligations
- Buyers must confirm receipt promptly or open a dispute within 7 days of delivery.
- False disputes or fraudulent claims may result in account suspension.
5.5 Disputes
If a dispute arises, both parties must provide evidence. We will review disputes and make a determination within 14 business days. Our decision is final within the platform, though this does not limit your rights under the CPA.
6. User Content
6.1 Your Content
You retain ownership of content you upload (photos, reviews, listings, route recordings, points of interest). By uploading content, you grant us a non-exclusive, worldwide licence to use, display, and distribute your content within the Service.
6.2 Content Standards
You must not upload content that:
- Is illegal, harmful, threatening, abusive, or defamatory.
- Infringes on intellectual property rights of others.
- Contains malware, spam, or misleading information.
- Violates the privacy of others without their consent.
We reserve the right to remove content that violates these standards without notice.
7. AI-Generated Content
Trip itineraries generated by our AI feature are provided for informational purposes only. AI-generated content may contain inaccuracies. You are responsible for verifying all information, including campsite availability, road conditions, and safety before embarking on any trip. We disclaim liability for any harm resulting from reliance on AI-generated content.
8. Location & Safety Features
8.1 SOS Feature
The SOS panic button is designed to share your location with your designated emergency contacts. It is not a substitute for emergency services. In an emergency, always contact 10111 (SAPS) or 10177 (ambulance) directly.
8.2 Signal Reports
Signal strength data is user-contributed and may not reflect current conditions. Network coverage varies and should not be relied upon for safety-critical decisions.
8.3 Route Recording
Routes recorded and shared publicly are at your own risk. We are not responsible for the accuracy or safety of user-contributed routes.
9. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose.
- Impersonate any person or entity.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorised access to other users' accounts or data.
- Scrape, harvest, or collect data from the Service without permission.
- Use the Service to send spam or unsolicited communications.
- Circumvent any security measures or access restrictions.
10. Bans & Enforcement
We may ban users who violate these Terms, engage in fraudulent marketplace activity, or exhibit abusive behaviour. Banned users forfeit access to the Service including any pending marketplace funds, subject to applicable law.
11. Intellectual Property
The Service, including its design, code, logos, and branding ("KampMal" and associated marks), is the property of Effek Studios. You may not copy, modify, distribute, or create derivative works without our written permission.
12. Third-Party Services
The Service integrates with third-party providers including Google Maps, PayFast, The Courier Guy, and Anthropic. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or reliability. This does not affect your statutory rights under South African law.
14. Limitation of Liability
To the maximum extent permitted by South African law, Effek Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: loss or damage to property during camping trips, marketplace transaction disputes, reliance on AI-generated itineraries, or failure of the SOS feature.
15. Indemnification
You agree to indemnify and hold harmless Effek Studios and its officers, employees, and agents from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa. Nothing in these Terms limits your rights under the Consumer Protection Act, 2008 (Act 68 of 2008).
17. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via push notification or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
18. Termination
You may delete your account at any time through the Settings screen. We may terminate or suspend your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (intellectual property, limitation of liability, indemnification) will survive termination.
